This is a report of an encounter with DPS at the Hotel Sutera Harbour Magellan on 25th October, 2011 at about 9.30am.
It was in the lobby of the Hotel where a Seminar by MIDA was held.
The title of the seminar was "Sabah Domestic Investment"
DPS first shook my hand and call me Mr Kong while DPS was in conversation with Peter Vitalis and Datuk Anthony Robert.
AJT kindly provided the photo of the ocassion when I presented a yellow book
to DPS for the purpose of joint effort to raise the issue on GE2004.
After presenting the yellow book, I asked DPS about the land deals where we were to have shared the commission.
So DPS told me, he has yet to receive any of the commission and the broker John M and the lawyers concerned had disappeared. I asked him who was the lawyer, DPS refused to tell me despite my repeated requests.
Then I told DPS that I understand he is very rich from land deals.
DPS replied he sold his 50 acres somewhere in Beaufort. Is this true?
DPS then asked me how is the KPSB and I told him KPSB lacks cash to have the programmes. DPS just kept silent.
DPS also told me he was regularly in Brunei.
The Peter Vitalis also want to buy my yellow book on the GE 2004.
This is a record for future reference.

Complaint against Mr Albert Tokuzip

We the undersigned would like to submit this complaint against the abovementioned person/lawyer.
2. The complaint of the event thereof arose in AT’s office at the KK Times Square on 18th October, 2011 at about 10 am.
3. We as led by Joshua Y. C. Kong (JK) went to AT’s office to make an inquiry on a land transaction supposedly done by AT with a reference NFT/Borneo/09/J974/AT of 27 October 2009.
4. After about ten minutes of conversation between JK and AT at the AT’s conference room, AT said “You waste my time” and as repeated and then AT left the room abruptly with his body language and tone of his voice as showing ‘anger’ and displeasure. The said minute of the ad hoc meeting is attached for your reference.
5. AT had stated that he did not conclude the deal in the land of two pieces of titles and this statement is also relevant in this complaint.
6. We believe AT’s behaviour and sort of ‘outburst’ was unethical and unprofessional in the context of dealing with any client possibly giving away a hidden agenda in this instance.
7. We hope the President and the Sabah Law Association would conduct your own investigation on this complaint.

Minute with AT
Minute of the ad hoc meeting at the Office of Nicholas Fung Tokuzip & Co (tel:088 486606) at the fifth floor of Block E No.27-5 of the K K Times Square, off Coastal Highway, Kota Kinabalu, at 10am on 18th October, 2011.
Venue: Conference Room
Purpose: To inquiry about the land transacted of two titles of 25,000 of Borneo Glow Sdn. Bhd.
Basis: The letter of NFT/Borneo/09/J974/AT of 27 October 2009 where AT is obvious.
Present: Joshua Y. C. Kong; Mary Chin Saw Yin; R. Kunjan; A J Tuining (visitors)

1. Joshua Kong started the conversation after a brief handshakes with A. Tokuzip.
2. Joshua Kong wanted to know what happen to the land transactions affecting two CL titles 095332862 and 095331749 located at Sg. Millian, Kinabatangan, Sabah referring to the said letter above-mentioned..
3. Mr A. Tokuzip talking out of his memory with great details of the said land told us that he did not conclude the deal and Datuk Tan, the son of Mr Tan (father and son -both directors and shareholders) of BGSB concluded the deal in Peninsular Malaysia.
4. Mr. A. Tokuzip did say that he tried to handle the said lands but failed to conclude it as Datuk Tan had the power to conclude the said deal hence Mr. A. Tokuzip admitted he missed the deal.
5. Mr. A. Tokuzip was very clear about the buyer as United Malacca Bhd and asked us to contact them.
6. .Mr. A. Tokuzip was upset and said that we wasted his time (repeated as well) as indicated by his body language and his tone of voice and left the conference room abruptly after spending about ten minutes with us.
